NEXT YEAR THE SUPREME COURT HAS THE CHANCE TO OVERTURN ROE V. WADE
One of the most prominent accomplishments of President Trump’s time in office has been the restoration of the Supreme Court to a 5-4 conservative majority.
Political commentators of all stripes have predicted that the current session of the court will specifically try to take cases involving abortion rights and the pro-life stance.
It’s an exciting opportunity to overturn the damage done by Roe v. Wade in 1973.
Here’s what to look for in the New Year:
The court’s current nine-month term started on October 7th and will address a multitude of cases involving immigration, discrimination against homosexual-identifying individuals, religious education, gun rights, and as predicted, abortion.
The Supreme Court has an unprecedented opportunity to set limits on abortion rights and perhaps even overturn the landmark abortion case of Roe v. Wade, which first ruled on a woman’s “right” to abort her child without government intervention.
The court is prepared to hear cases about abortion bans and restrictions in Indiana, Louisiana, Alabama, and more, with rulings set to be delivered by next June.
Chief Justice John Roberts, who is reportedly “the court’s ideological center,” is projected to offer a conservative viewpoint on the issue of abortion rights, as are Justice Neil Gorsuch and Justice Brett Kavanaugh, both of whom were appointed by President Trump.
These conservative Justices know that voters and Christians across America are waiting to hear a verdict on the possibility of abortion bans or restrictions.
“I have to believe they will take one [of these abortion-centric cases] sooner rather than later. It’s clear notwithstanding all the decades since Roe v. Wade that there is intense disagreement among Americans,” said John Bursch, a lawyer with Alliance Defending Freedom.
Alliance Defending Freedom is one of several organizations working to oppose abortion in the public and political spheres.
“Anytime you have that much turmoil in the political process it’s going to create conflicts the court must address,” Bursch continued.
In other words, the court can’t ignore what the people of America are saying.
Naturally, pro-abortion activists are defensive about the possibility of a new Supreme Court ruling on Roe v. Wade. Many claim that it would be wrong for the court to revisit abortion law at all.
“There should be no reason for the Supreme Court to revisit Roe, but we know this is exactly what some of the states are trying to do and what President Trump was looking for in his Supreme Court nominees,” said Jennifer Dalven, who works for the American Civil Liberties Union.
It’s true – during his 2016 campaign, President Trump made a promise to appoint Supreme Court Justices who would overturn Roe v. Wade. Now, he’s trying to keep that promise and abortion advocates are outraged.
“The stakes are incredibly high this term,” Dalven concluded, and she is correct. The court has the opportunity to accomplish much in the next several months.
The various abortion cases that will come before the court during this term involve restrictions on abortion providers, ultrasound requirements, and prohibitions on abortions after six weeks of pregnancy.
Abortion laws and options in Louisiana, Mississippi, Kentucky, Arkansas, Alabama, Ohio, Georgia, and Indiana will come under scrutiny. Abortion advocates will try to defend women’s “right” to abortion and the court will need to decide if it truly prioritizes the lives of unborn children.
Public opinion on abortion is changing more than abortion advocates would like to admit. A recent survey found that more states than ever are “hostile” or “very hostile” toward the idea of abortion in any form.
This is encouraging news for the pro-life movement, but a ruling from the Supreme Court will be incredibly powerful in the movement against abortion.
In addition to conservative Justice Roberts, Gorsuch, and Kavanaugh, Justice Clarence Thomas has made his stance on abortion fairly clear. “The Constitution itself is silent on abortion,” Thomas recently wrote, asserting that there is no such “right” presented in the Constitution.
With the help of Justice Samuel Alito, who usually identifies himself as a political conservative in court rulings, these Justices could make great strides toward abolishing abortion despite strong opposition from the pro-abortion movement.
