What’s Happening:
Texas is bringing a case against four swing states over their election results. And it has Americans talking.
The case, which will be brought before the Supreme Court, was commented on by Trump himself. He said he would join the case, calling it the “big one.”
A handful of other Trump-supporting states might be backing it as well. Now, Trump’s top lawyer, Jay Sekulow, is giving his take on this case:
“What is at stake here, and this is why I think out of all the cases this is the most significant – to be clear, there’s no doubt about it – this is the most significant of the cases that has been filed. It’s the most significant because it is completely outcome determinative. What does that mean? It means that if the Court were to rule in favor of Texas, those four states, the states named in the complaint, would in in fact have their state legislatures determine the outcome. They would pick the electors.

Jay Sekulow is saying this case is what “we’ve been waiting for.” He is echoing what Trump says been saying, that it is “very strong” and that “all criteria” have been met.
Sekulow explains this case will decide the election because it addresses many of the problems Trump’s legal team has discussed.
It is, as he said, “completely outcome determinative.” Meaning this case could clearly decide who becomes president.
Sekulow also explains that this case, if ruled in Trump’s favor, could give state legislatures the power to award their electors to a candidate—rather than the allegedly tainted popular vote.
In that case, three out of the four states have Republican legislatures (with Pennsylvania having a split House and Senate).
If that isn’t the outcome, there is also the chance that the court will require the House of Representatives to decide the election. In that case, each state legislature would be given one vote.
(And Republicans have a 30-20 advantage).
It seems this case will decide the presidency, which is why Trump is putting all his effort into backing it. By the end, many groups might be joining this case, giving greater weight to their arguments.
In fact, one of the latest updates shows that 17 states have signed onto it. If that isn’t a ringing endorsement for Texas’s argument, we’re not sure what is.
