As I shared with you a few days ago, the Fourth Circuit Court

of Appeals issued a 2-1 adverse ruling regarding our case

against ObamaCare.

This ruling is all over the place! One judge on the 3-judge

panel would uphold ObamaCare under the government's power

to tax, although 10 judges have thus far said the individual

mandate is a "penalty," not a "tax."

Another of the three judges would uphold ObamaCare under

the Commerce Clause, saying the government can force law

abiding citizens to purchase anything it deems appropriate.

If this court's logic prevails, you and I will be forced

to live under ObamaCare's unconstitutional mandate!

      But, thankfully, this ruling is only the next step

      on the path to the final round at the U.S. Supreme

      Court.  The two judges appointed by Barack Obama

      and one by Bill Clinton will NOT have the final say

      on ObamaCare!

That is why Liberty Counsel will soon be formally filing

our appeal of the Fourth Circuit's ruling - thereby taking

our case directly to the U.S. Supreme Court.

++This is the most crucial phase of our ObamaCare lawsuit.

Everything that has gone before this appeal

was designed to get us to this point in the best possible

position.  My team must respond in the next few weeks, and

we are carefully considering how to maximize the impact of

our filing.

      As a result, I must immediately invest every available

      legal resource to craft our appeal.  We must challenge

      this dangerous, evasive ruling from the appellate

      court because if it is allowed to go unchallenged,

      it could force Americans to accept ObamaCare's

      outrageous dictates.

As I mentioned, we have only a few weeks to file this all-

important appeal to the U.S. Supreme Court. I must move

I know this is a very direct message and I don't want to

create the impression that we are in any way discouraged

or less certain of our eventual victory. Here is the hopeful

      Our case could be the first to be heard by the U.S.

      Supreme Court and the first to strike a legal death

      blow against the heinous ObamaCare law.

      precedent on our side to have our case heard and to

      achieve a sweeping rejection of this court-ordered
